NEW ADVISORY ISSUED ON TRADEMARK FOR NAME RESERVATION OF COMPANY & LLP
Before submitting a proposed Company & LLP Name, first check if it conflicts with any existing registered trademarks. To do this:
Compare the word in your proposed name with registered trademarks.
Match your business activity (NIC code) with the relevant trademark class
Make sure no registered trademark exists in the same class with similar business activities.
If your proposed name is similar to an existing registered trademark in the same type of business, it may be rejected. Checking in advance, you can avoid rejection or having to resubmit.
NIC Code for Government Activities
Avoid selecting NIC codes meant for government functions (like public administration, defense, social security, etc.), as these are not allowed for private companies/LLPs.
NOC for Trademark Use
If you are using a registered trademark, you must submit an NOC with a valid Digital Signature (DSC) of the trademark owner or authorized person.
NOC from Body Corporate
If the NOC is issued by a company or corporate entity, it must be:
On official letterhead
Digitally signed by an authorized signatory
Mention Trademark Details
The Trademark Class and Application Number must be clearly mentioned in the NOC for proper verification.
Selection of First NIC Code
The first NIC code represents your main business activity and is linked to your CIN, so it must be selected carefully.
Consistency in Business Details
Ensure that the NIC code matches the company’s objects, so your business activity aligns with legal and regulatory requirements.
